Welcome to Wellness Hub TH (operated by LESLIE PARRA LLC, hereinafter referred to as "the Company", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the website located at thetomorrowthailand.net (the "Site") and all related services, content, features, and functionality offered by us (collectively, the "Services"). Please read these Terms carefully before using our Site or Services.
1. Acceptance of Terms
By accessing or using the Site in any manner โ including, but not limited to, browsing, registering an account, submitting information, or purchasing products or services โ you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Site and Services.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and the Company. If you are accessing or using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, and in such cases "you" and "your" shall refer to that entity.

The Company reserves the right, at its sole discretion, to modify, suspend, discontinue, or restrict access to any part of the Services at any time, with or without notice and without liability to you or any third party. We do not guarantee that the Site or any portion of it will always be available, error-free, or uninterrupted.
The information provided on this Site is intended for general wellness and informational purposes only. Nothing on this Site constitutes professional medical advice, diagnosis, or treatment. 3. User Responsibilities and Acceptable Use
As a condition of your use of the Site and Services, you agree to comply with all applicable laws and regulations, including those of the Kingdom of Thailand. You agree that you will not engage in any of the following prohibited activities:
- Using the Site for any unlawful purpose or in violation of any local, national, or international law or regulation;
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity;
- Harvesting, scraping, or collecting email addresses or other personal information from the Site without our express written consent;
- Uploading, transmitting, or distributing any computer viruses, worms, malware, or any software intended to damage or alter a computer system or data;
- Interfering with, disrupting, or overburdening the Site's infrastructure or the servers and networks connected to the Site;
- Attempting to gain unauthorised access to any portion of the Site, other user accounts, or any systems or networks connected to the Site, through hacking, password mining, or any other means;
- Using the Site to send unsolicited or unauthorised advertising, promotional materials, spam, chain letters, or any other form of unsolicited communication;
- Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Site or its content without our express written permission;
- Engaging in any conduct that restricts or inhibits any other user from using or enjoying the Site;
- Posting or transmitting any content that is defamatory, obscene, pornographic, abusive, offensive, or otherwise objectionable under applicable Thai law, including but not limited to the Computer Crimes Act B.E. 2550 (2007) and its amendments.
You are solely responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security. The Company will not be liable for any losses arising from your failure to comply with this obligation.
4. Intellectual Property Rights
All content available on the Site โ including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the overall appearance and layout of the Site โ is the exclusive property of LESLIE PARRA LLC or its content suppliers and is protected under applicable intellectual property laws, including those of Thailand and international treaties.
The trademarks, service marks, trade names, and logos displayed on the Site are registered and unregistered marks of the Company or third parties. Nothing contained on the Site should be construed as granting any licence or right to use any trademark without our prior written permission or the permission of the third-party owner of the trademark.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and its content solely for your personal, non-commercial purposes. This licence does not include the right to: (a) modify or create derivative works; (b) distribute, publicly perform, or publicly display any content; (c) use data mining or similar data-gathering tools; or (d) use the Site in any manner that could damage, disable, or impair the Site.

5. User-Generated Content
To the extent that the Site permits you to submit, post, upload, or otherwise contribute content ("User Content"), you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and fully sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media. You represent and warrant that you own or control all rights to the User Content and that such content does not violate these Terms, any applicable law, or the rights of any third party. The Company reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content at its sole discretion.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
The Company does not warrant that: (a) the Site will be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Site is free of viruses or other harmful components; or (d) the results of using the Site will meet your requirements. Any content downloaded or otherwise obtained through the use of the Site is accessed at your own risk, and you will be solely responsible for any damage to your device or loss of data that results from such access.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE CIVIL AND COMMERCIAL CODE OF THAILAND, LESLIE PARRA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES โ INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE GOODS OR SERVICES โ ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the greatest extent permitted by law. In all cases, the Company's total aggregate liability to you for all claims arising out of or related to your use of the Site or Services shall not exceed the greater of: (a) the total amount paid by you to the Company in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) Thai Baht 1,000 (THB 1,000).
8. Indemnification
You agree to defend, indemnify, and hold harmless LESLIE PARRA LLC, its affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable legal fees) arising from or related to: (a) your use of and access to the Site or Services; (b) your violation of any term of these Terms; (c) your violation of any applicable law or regulation, including any applicable Thai law; (d) your violation of any third-party right, including any intellectual property right or privacy right; or (e) any User Content you submit or transmit through the Site.
This obligation will survive the termination of your relationship with the Company and your cessation of use of the Site.
9. Third-Party Links and Content
The Site may contain links to third-party websites, resources, advertisers, or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We do not endorse or make any representations or warranties about third-party websites. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any such third-party content, goods, or services.
10. Privacy and Personal Data
Your privacy is important to us. The collection, use, storage, and disclosure of your personal data is governed by our Privacy Policy. By using the Site, you consent to the collection and use of your information in accordance with our Privacy Policy. Our data practices are designed to comply with the Personal Data Protection Act B.E. 2562 (2019) (PDPA) of Thailand. We encourage you to review our Privacy Policy carefully.
11. Force Majeure
The Company shall not be held liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, earthquakes, floods, storms, epidemics or pandemics, war, terrorism, civil unrest, governmental actions or regulations, power outages, internet or telecommunications failures, cyberattacks, strikes or labour disputes, or any other event of force majeure.
In the event of a force majeure situation, the Company will use commercially reasonable efforts to resume normal operations as quickly as possible.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms.
Subject to the dispute resolution provisions set out in Section 13, you agree that the courts of competent jurisdiction located in Bangkok, Thailand shall have exclusive jurisdiction to adjudicate any dispute arising out of or relating to these Terms or your use of the Site.
13. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any Services provided by the Company, the parties agree to attempt to resolve the dispute through the following sequential process:
- Informal Negotiation: Either party wishing to initiate a dispute must first provide written notice to the other party describing the nature of the dispute and the relief sought. The parties shall have thirty (30) calendar days from the date of such notice to attempt to resolve the dispute through good-faith negotiation.
- Mediation: If the dispute cannot be resolved through informal negotiation within the period specified above, the parties agree to submit the dispute to mediation administered by a mutually agreed mediator or, failing agreement, through the mediation services of the Thai Arbitration Institute (TAI) under its prevailing rules and procedures. The mediation shall be conducted in the Thai language or English as agreed, in Bangkok, Thailand.
- Arbitration or Litigation: If mediation fails to resolve the dispute within sixty (60) calendar days of the commencement of mediation proceedings (or such longer period as the parties may agree in writing), either party may submit the dispute to: (a) binding arbitration administered by the Thai Arbitration Institute (TAI) in Bangkok, Thailand, applying Thai law, with arbitration proceedings to be conducted in English or Thai as agreed between the parties; or (b) the courts of competent jurisdiction in Bangkok, Thailand, as specified in Section 12 above.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
14. Modification of Terms
The Company reserves the right to modify, update, or replace any part of these Terms at any time at its sole discretion. When we make material changes to these Terms, we will provide notice by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying you via email or through a prominent notice on the Site.
Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates. If you do not agree to the modified Terms, you must stop using the Site and Services immediately.
15. Termination
The Company reserves the right, at its sole discretion, to terminate, suspend, or restrict your access to all or any part of the Site and Services at any time, with or without cause, with or without prior notice, and without liability to you. Grounds for termination may include, but are not limited to: violation of these Terms, conduct that the Company believes is harmful to other users, third parties, or the Company's interests, or for any other reason at the Company's discretion.
Upon termination, your right to use the Site and Services will immediately cease. If your account is terminated, we may, but are not obligated to, delete any content or information associated with your account. All provisions of these Terms which by their nature should survive termination shall do so, including but not limited to: intellectual property rights, disclaimer of warranties, indemnification, limitation of liability, and governing law provisions.
You may terminate your use of the Site at any time by ceasing to access the Site and, if applicable, by closing your account by contacting us at [email protected].
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason under applicable law, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties to the greatest extent possible.
17. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by the Company on the Site, constitute the entire agreement between you and LESLIE PARRA LLC with respect to your use of the Site and Services. They supersede all prior and contemporaneous agreements, representations, warranties, and understandings โ whether written or oral โ between you and the Company relating to the same subject matter.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. Any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
18. No Waiver
The failure of the Company to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full effect.
19. Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without the prior written consent of the Company. The Company may freely assign these Terms, in whole or in part, including in connection with a merger, acquisition, reorganisation, sale of assets, or by operation of law, without notice or your consent. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
20. Electronic Communications
By using the Site and Services, you consent to receive electronic communications from us. These communications may include notices about your account, transactional information, and promotional communications. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically satisfy any legal requirements that such communications be in writing, to the extent permitted by applicable Thai law.
